The General Services Administration (GSA) has proposed a sweeping new rule that would require
every organization receiving federal funding—including
- nonprofits,
- universities,
- cities, and
- state agencies
—to
sign certifications, under penalty of federal law, affirming they comply
with:
- Vague and legally
inaccurate statements about anti-discrimination law,
effectively targeting lawful DEI
efforts;
- A certification that they
are not helping or harboring "illegal aliens;"
- A certification that they
are not engaged in activities the Administration
has broadly—and
questionably—designated as "terrorist."
If finalized, this rule could weaponize the False Claims Act
- against
organizations that pursue entirely lawful activities,
- chilling
free speech and
forcing
- vital
community institutions to choose between their mission and their funding.
