The General Services Administration (GSA) has proposed a sweeping new rule that would require every organization receiving federal funding—including

  • nonprofits,
  • universities,
  • cities, and
  • state agencies

—to sign certifications, under penalty of federal law, affirming they comply with:

          - Vague and legally inaccurate statements about anti-discrimination law,

             effectively targeting lawful DEI efforts;

          - A certification that they are not helping or harboring "illegal aliens;"

          - A certification that they are not engaged in activities the Administration

             has broadly—and questionably—designated as "terrorist."

If finalized, this rule could weaponize the False Claims Act

  • against organizations that pursue entirely lawful activities,
  • chilling free speech and forcing
  • vital community institutions to choose between their mission and their funding.
